Terms of service

Commercial activation pending: these terms set out the intended B2B contract and the known operator details. Checkout and customer-file intake remain disabled until the registration number, tax position, GDPR representation, retention controls, DPA and final legal review are verified. Unresolved operator and activation details remain explicitly marked as pending below.

These Terms govern business use of PackDossier at packdossier.org. An accepted order form may add service-specific terms. If there is a conflict, the order form controls for that order, then an agreed data processing agreement, then these Terms.

1. Contracting operator and contact

The service provider is Blue Ridge Federal LLC, with its business address at 2504 Ditmars BLVD, New York City, New York 11105, United States.

2. Business customers only

PackDossier is offered only to persons acting for purposes relating to their trade, business, craft or profession. By creating a workspace or placing an order, you represent that you are authorised to bind the named organisation and are not contracting as a consumer. If that is not correct, do not purchase the service. Mandatory rights that cannot lawfully be excluded remain unaffected.

3. Service and account access

PackDossier organises customer-supplied packaging evidence, proposes extracted facts, identifies apparent evidence gaps, prepares review-ready records and supports controlled sharing. Access is non-exclusive, non-transferable and limited to authorised users during the applicable order. You must provide accurate account information, protect credentials and promptly report suspected unauthorised access. You are responsible for your users and for approvals made through your workspace.

4. Founding pilot

The founding pilot is a one-time fee of €250, as its base subtotal, excluding VAT or other indirect taxes where applicable. It covers ten packaging constructions identified in a written scope. The pilot starts on the activation date confirmed in writing after the agreed source materials have been supplied by the recorded source date and PackDossier has confirmed that they are sufficient to perform the agreed work.

Output guarantee. If ten packaging constructions are agreed in writing, all agreed source materials are supplied by the recorded source date and assessed sufficient, and PackDossier cannot deliver 10 exportable, review-ready dossiers within 30 calendar days of the agreed pilot start date, the 250-euro pilot fee is refunded. Time is paused for customer delay, inaccessible or corrupted files, material scope changes, or missing decisions, and any revised date must be recorded in writing. The refund is the sole remedy under this output guarantee. It is not a guarantee of legal conformity, certification, authority or customer acceptance, sales, or the truth of customer or supplier evidence.

5. Optional subscription after pilot approval

The pilot does not automatically enrol you in a subscription. If you affirmatively approve a separate subscription order after the pilot, the price is €299 per site per month, excluding applicable VAT or other indirect taxes. It renews monthly until cancelled. You may cancel before the next renewal, with access continuing to the end of the paid billing period. There is no annual commitment unless a later signed order expressly says otherwise. Partial billing periods are not refunded except where required by law or expressly stated in the order.

6. Payment, invoices, taxes and refunds

Fees, currency, tax treatment and the total payable will be shown before purchase. Payments may be processed by Stripe. You authorise the charges stated at checkout and must keep billing and VAT information accurate. You are responsible for taxes that lawfully apply to your purchase, except taxes on PackDossier's income. Stripe Tax or another calculation tool does not itself determine either party's legal registration obligations. Failed or overdue payments may result in proportionate suspension after notice.

Except for the founding output guarantee, an express order-form remedy, a billing error, or a non-excludable legal right, fees are non-refundable. Approved refunds are returned to the original payment method where practicable. Chargeback rights and statutory payment protections remain unaffected.

7. Preview, delivery and approval

A limited preview may show part of a proposed dossier before full paid access. A preview is incomplete, may omit qualifications and must not be relied on or distributed as a final record. Full outputs remain proposed or review-ready until an authorised human approves them. You must check every material fact, source link, missing-evidence flag, date, supplier attribution and declaration before use or publication.

Incomplete uploads expire within 24 hours. Free-preview source files, rendered or raster pages and derived preview records are retained for no more than 30 days from upload unless you delete them sooner or move them into an active service workspace.

8. PPWR and no-certification boundary

PackDossier is workflow software. It is not a notified body, certification service, testing laboratory, market-surveillance authority or legal adviser. It does not perform a conformity assessment, independently test packaging or certify compliance with Regulation (EU) 2025/40 on packaging and packaging waste (PPWR), food-contact rules or any other law. Under the PPWR, the responsible manufacturer remains accountable for the conformity assessment, technical documentation and EU declaration of conformity. Economic operator roles, applicable requirements, dates, standards and guidance must be assessed for each product and market. See the official PPWR text on EUR-Lex. Workspace retention is not a substitute for the responsible operator's statutory document-retention duties; customers must export and retain the controlled record for the required period.

9. Customer materials and instructions

You retain ownership of files, data, marks and instructions you submit (Customer Materials). You grant PackDossier and its approved subprocessors a limited licence to host, copy, transform and transmit Customer Materials only as needed to provide, secure, support and comply with the service. You represent that you have the rights, notices and lawful basis needed to provide them, including supplier confidential information and personal data. Do not upload unnecessary special-category personal data, unlawful content, malware or controlled information that the agreed service is not authorised to handle.

10. Confidentiality and data processing

Each party will use the other's non-public information only to perform the agreement, protect it with reasonable care and disclose it only to personnel, advisers and subprocessors who need it and are bound by appropriate duties. This does not cover information already lawfully known, independently developed, public without breach or lawfully received from another source. Legally compelled disclosure is permitted after notice where lawful. Where PackDossier processes personal data for you as processor, the PackDossier DPA, once accepted for the order, applies. The current and proposed service providers are identified in the provider register. PackDossier does not claim a right to train general-purpose models on Customer Materials.

11. Product intellectual property and outputs

PackDossier and its licensors own the service, software, interfaces, templates, methods, documentation and improvements. No rights are granted except the limited access right in these Terms. Subject to payment and third-party rights, you may use and adapt delivered outputs for your internal business, customers and regulatory work. Reusable formats, generic structures, know-how and features are not assigned exclusively. If you provide feedback, PackDossier may use it without identifying you or disclosing Customer Materials.

12. Acceptable use

You must not:

  • use the service unlawfully, deceptively or to create unsupported compliance claims;
  • probe, disrupt, bypass access controls or introduce malicious code;
  • access another customer's data or share controlled links outside their intended recipients;
  • resell, scrape, reverse engineer or copy the service except where law expressly prevents restriction; or
  • remove source qualifications, review states or no-certification notices in a misleading way.

13. Security, maintenance and third-party services

PackDossier will apply reasonable technical and organisational measures appropriate to the service and will use commercially reasonable care in providing it. Maintenance, emergencies, customer systems, internet failures and third-party providers may affect availability. No uninterrupted or error-free service level is promised unless stated in a signed order. Third-party services are subject to their own availability and terms; PackDossier remains responsible for its contractual use of subprocessors as stated in the DPA.

14. Suspension, termination, export and deletion

Either party may terminate for an uncured material breach after reasonable written notice. PackDossier may suspend immediately to contain a credible security threat, unlawful use or material risk, and will limit the suspension where practicable. On termination, fees already due remain payable. While the service is active, Customer Materials and derived evidence remain under your workspace control and are kept only as needed to provide the service.

For 30 days after termination, you may export available Customer Materials and paid outputs in supported formats and complete account closure. At the end of that window, PackDossier starts the application-level purge of Customer Materials and derived evidence. Independent encrypted backup archives, once activated, age out within 30 days; they are unavailable for routine access and used only for recovery. Controlled evidence links and supplier-request channels may expire or be revoked earlier under their access settings.

Billing, tax, contract, security, dispute and suppression records may be kept for the applicable statutory, limitation, fraud- prevention or objection-handling period. A deletion cannot remove a copy that you or an authorised recipient already exported, and a documented legal hold may pause deletion to the extent required. The stated production schedule does not become operational until its automated deletion and backup controls are activated and verified.

15. Warranties and disclaimers

Each party warrants that it has authority to enter the agreement. PackDossier warrants that it will perform agreed services with reasonable skill and care. To the fullest extent permitted by law, all other warranties are excluded, including implied warranties of merchantability, fitness for a particular purpose, non-infringement and that outputs are complete or legally sufficient. Source-backed extraction reduces review effort but can still be inaccurate, incomplete or affected by poor source material.

16. Liability

Nothing excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, wilful misconduct, or death or personal injury caused by negligence where applicable. Subject to that rule, neither party is liable for indirect or consequential loss, lost profit, revenue, business, goodwill or anticipated savings. Each party's aggregate liability arising from the service is limited to fees paid or payable for the affected service during the 12 months before the event; if the only order is the founding pilot, the cap is the pilot fee. These limits apply only to the extent permitted by the approved governing law and may be adjusted in a signed order or DPA.

17. Third-party claims

To the extent permitted by law, you will defend and indemnify PackDossier against a third-party claim caused by Customer Materials that you had no right to provide, or by your unlawful or deliberately misleading use of the service. This does not apply to the extent the claim was caused by PackDossier. The protected party must give prompt notice, reasonable cooperation and control of the defence, and no settlement may admit fault or impose non-monetary duties on it without consent.

18. Changes

PackDossier may update these Terms for legal, security or service changes. Material changes will be notified in advance through the service or account contact and apply from the stated date. Changes will not retroactively remove an accrued right or alter a paid pilot scope without agreement. Continued use after the effective date constitutes acceptance; if you do not agree, cancel before then.

19. Governing law and disputes

Proposed pre-launch position: These Terms and non-contractual disputes are governed by the laws of the State of New York, without regard to conflict-of-laws rules, without regard to conflict-of-law rules. The parties submit to the state courts located in Queens County, New York, and the United States District Court for the Eastern District of New York, subject to mandatory law, subject to any mandatory forum or right that cannot be waived. Before filing, each party will give a business contact 30 days to attempt a good-faith resolution, unless urgent relief is needed.

20. Entire agreement and notices

These Terms, an accepted order and any applicable DPA are the entire agreement for the service and replace prior statements about it. Failure to enforce a term is not a waiver. Invalid provisions are limited only as necessary, and the remainder continues. Neither party may assign the agreement without consent, except with a merger or sale of substantially all relevant assets where the assignee assumes it. Formal notices must be sent to the contact stated in the order and, once published, the operator contact above.
